Release and Waiver 

I am registering for the Group for New Moms facilitated by J Hoffman Therapy, LLC dba Instar HealingTM and its members, Rebecca Cohen, MFT Intern and Owner, Jennifer Hoffman, LCSW.

The Group for New Moms, among other things, includes some meetings that entail walking along unpaved trails and other terrains. I understand and acknowledge that such activities expose its participants to certain risks, such as, but not limited to, trip and fall hazards, animal encounters, and potential exposure to insects, poison oak, poison ivy, plants and pollen and the risks of allergic reactions. Additionally, weather and temperature-related conditions such as dehydration and heat exhaustion are a risk, and adequate medical care may not be available on a timely basis. These risks include risks of bodily injury, disability and death.  

I knowingly and voluntarily agree to release from, waive, and agree not to sue J Hoffman Therapy, LLC dba Instar HealingTM; its owner(s); employees; agents; independent contractors; representatives; and interns, including but not limited to Rebecca Cohen, MFT Intern, and any other person acting under the direction of, or on behalf of J Hoffman Therapy, LLC dba Instar Healing (collectively, “the Releasees”) for any and all claims, damages, costs, attorney's fees, or causes of action which I have or may have in the future as a result of damages or injuries relating to or arising from my participation in the Group for New Moms, including any such damages or injuries arising out of, or resulting from, any negligent act, omission or recklessness by the Releasees (the “Released Claims”). I knowingly and voluntarily agree to assume all of the risks of participating in the Group for New Moms facilitated by J Hoffman Therapy, LLC dba Instar HealingTM. 

I HAVE CAREFULLY READ, AND I UNDERSTAND, ACKNOWLEDGE, AND AGREE TO THIS RELEASE AND WAIVER OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT. I UNDERSTAND THAT I AM GIVING UP VALUABLE LEGAL RIGHTS BY SIGNING THIS AGREEMENT AND THAT THIS AGREEMENT REPRESENTS A CONTRACT BETWEEN THE RELEASEES AND MYSELF. I HAVE VOLUNTARILY CHOSEN THE ACTIVITIES IN WHICH I AM PARTICIPATING. 

Parental Consent and Release of Liability for Minor Participants: 

I am the parent or legal guardian. I hereby give my permission for my child/ward to participate in the Group for New Moms (hereafter, the “Program”), facilitated by J Hoffman Therapy, LLC dba Instar HealingTM; including all outdoor group activities. I understand and agree that the activities have risks, as outlined above in the Release and Waiver which I incorporate herein, and I voluntarily assume these risks on behalf of my child/ward. I further agree to release, waive, and hold harmless the Releases named above in the Release and Waiver from any and all Released Claims. I acknowledge that I have read and understand this consent and release and that by signing below, I am giving up legal rights on behalf of my child/ward. In connection with my child’s/ward’s participation in the Program, I hereby waive all rights to any claim, cause of action, and/or the right to file a law suit against the Releasees. I further release the Releasees from any and all responsibility or liability of any nature whatsoever for any loss or damage to my child’s/ward’s person or property, including, but not limited to, personal injury and/or death sustained by, as a result of, incidental to, my child’s/ward’s particpation in the Program. 

This Waiver and Release of Liability is binding upon my and my child/ward’s personal representatives, trustees, heirs, successors, beneficiaries, relatives, next of kin or assigns and shall inure to the benefit of all Releasees named herein as well as to their directors, officers, sponsors, employees, agents, volunteers, successors and assigns.

I represent that I am the parent or legal guardian of the above-named Minor Child. I have carefully read this Consent and Release of Liability. By my signature, I am stating that I understand, agree to, and accept all of its provisions, and understand that I am giving away substantial legal rights for both myself and for my child/ward.
